These Terms govern your use of the Alayé Permanent Jewelry website, booking system, mobile services, pop-ups and private events. By booking with us, attending an event, or using our website, you agree to these Terms.
1. Appointment Booking
- Appointments must be booked in advance through our website or scheduling system.
- You must arrive on time so we can serve every guest fairly — arrivals more than 10 minutes late may need to reschedule.
- We reserve the right to refuse service for any reason, including safety concerns.
2. Cancellations & Rescheduling
- A $20 deposit is required to reserve a personal appointment.
- Personal appointments may be rescheduled up to 24 hours in advance at no charge.
- Cancellations within 24 hours may forfeit the deposit.
- No-shows may be charged a fee or required to prepay future appointments.
3. Private Parties & Events
- A $75 non-refundable deposit is required to reserve a private party or event date.
- The deposit goes toward your event total but may not be refunded if the event is cancelled.
- Deposits may be applied to a rescheduled date with at least 7 days' notice.
- Final guest count and minimum spend (if applicable) are confirmed before the event.
- Travel fees may apply for events outside our immediate New Jersey service area.
- The host is responsible for guest behavior and any damage to property at the event.
4. Payment Terms
Payment is due in full at the time of service unless otherwise agreed in writing. We accept major credit cards and other payment methods displayed at checkout. All prices are in USD and subject to applicable New Jersey sales tax.
5. Permanent Jewelry Risk Disclosure
By receiving permanent jewelry services, customers acknowledge and accept that permanent jewelry is not indestructible and may break due to normal wear, accidental snagging, pressure, or misuse.
The welding process produces a brief, low-energy spark; while there is no needle and no heat applied to your skin, customers with pacemakers, defibrillators, or other electrical medical devices must inform us before service.
Some individuals may experience adverse skin reactions to certain metals or alloys, including redness, itching, swelling, irritation, or contact dermatitis. Customers with known metal allergies or sensitivities must disclose them before service. If any of these symptoms occur after service, the piece should be removed and a medical professional consulted if symptoms persist or worsen.
Customers voluntarily assume all risks associated with permanent jewelry services, including but not limited to chain breakage, metal sensitivity, allergic or adverse skin reactions, accidental damage, and loss.
6. Waiver
All clients receiving welded jewelry must complete and sign our waiver prior to service. The waiver is incorporated into and part of these Terms. Without a signed waiver, service will be declined.
7. Minors
Clients under the age of 18 must be accompanied by a parent or legal guardian who provides consent and signs the waiver on their behalf.
8. Liability Limitations
To the fullest extent permitted by law, Alayé Permanent Jewelry, its owners, employees and contractors are not liable for:
- Indirect, incidental, special or consequential damages
- Loss, theft or damage of jewelry after it leaves our event
- Allergic reactions when known sensitivities were not disclosed
- Damage caused by misuse, accidents, or failure to follow aftercare guidance
Our maximum liability for any claim related to a service will not exceed the amount you paid for that specific service.
9. Intellectual Property & Content
All website content, photography, branding, copy, designs and trademarks are the exclusive property of Alayé Permanent Jewelry and may not be reproduced, distributed or used without written permission. By submitting reviews, photos or testimonials to us, you grant us a non-exclusive, royalty-free license to use that content for marketing purposes (with the option to credit you on request).
10. Photography at Events
We may photograph appointments and events for marketing and social media. If you prefer not to be photographed, please let us know at the start of your appointment and we will respect that.
11. SMS & Email Communications
By providing your phone number and opting in, you consent to receive transactional and (optionally) marketing SMS messages from us, subject to our Privacy Policy. Reply STOP to opt out at any time.
12. Website Use
You agree not to misuse our website, including by attempting to access non-public areas, scraping content, transmitting malware, or interfering with normal operation. We may suspend or terminate access without notice for misuse.
13. Modifications
We may modify these Terms or our services at any time. Updates will be reflected on this page with the effective date above.
14. Governing Law
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in New Jersey.
